Terms of Service
1. Agreement to Terms
By downloading, installing or using PocketGyms, you agree to be bound by these Terms of Service. PocketGyms is operated by Private Gymnasium Ltd, registered in England and Wales. Company number: 14635927. Registered office: Northgate Business Centre, 38 North Gate, Newark, England, NG24 1EZ.
2. Eligibility
You must be at least 13 years old to use PocketGyms. If you are under 18, you confirm you have parental or guardian consent.
3. Your Account
You are responsible for maintaining the security of your account credentials. Do not share your password. You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these terms.
4. Subscriptions and Payments
PocketGyms offers free and paid subscription tiers. iOS App Store subscriptions are managed by Apple — billing, renewals and cancellations are subject to Apple's terms, manageable in your Apple ID settings. Web subscriptions are processed by Stripe, manageable via account settings. All fees are non-refundable except where required by law. UK users have a 14-day cooling off period for new paid subscriptions unless the service has been fully performed with your consent. Prices may change with reasonable notice.
5. Acceptable Use
You agree not to: use the app for any unlawful purpose, reverse engineer or decompile the app, use automated tools to scrape data, attempt unauthorised access to the app or its infrastructure, upload harmful or illegal content, impersonate any person or entity, or interfere with the proper functioning of the app.
6. Health and Fitness Disclaimer
PocketGyms provides fitness tracking and nutritional tools for general informational purposes only. PocketGyms is not a medical service and does not provide medical advice. Content including workout plans, nutritional targets, calorie calculations and recovery scores is not a substitute for professional medical or fitness advice. Consult a qualified healthcare professional before starting any new exercise or nutrition programme, particularly if you have pre-existing health conditions. You use PocketGyms entirely at your own risk.
7. Intellectual Property
All content, design, code and trademarks in PocketGyms are owned by Private Gymnasium Ltd or our licensors. You may not copy, reproduce or distribute any part of the app without our express written permission. Your personal data and workout logs remain yours.
8. Availability and Updates
We aim to keep PocketGyms available at all times but cannot guarantee uninterrupted access. We may carry out maintenance or updates at any time and reserve the right to add, remove or modify features with or without notice.
9. Limitation of Liability
To the fullest extent permitted by law, Private Gymnasium Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages. Our total liability shall not exceed the amount you paid us in the preceding 12 months or £50, whichever is greater. Nothing limits our liability for death, personal injury caused by negligence, or liability that cannot be excluded by law.
10. Termination
You may delete your account at any time via Profile → Account → Delete Account. Deleting your account permanently removes all associated data including workouts, nutrition logs and progress. This cannot be undone. We may suspend or terminate your account if you breach these terms.
11. Changes to These Terms
We may update these terms from time to time. We will notify you of significant changes via the app or email. Continued use constitutes acceptance.
12. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Privacy
Your use of PocketGyms is also governed by our Privacy Policy, available at pocketgyms.app/privacy.
